1. Agreement to Terms

These Terms of Service ("Terms") constitute a binding agreement between you and CustomGForm, operated by Ihor Zymnitskyi (Jednoosobowa Działalność Gospodarcza (JDG) registered in Poland, NIP: 5833499693, REGON: 527544670) ("CustomGForm", "we", or "us").

By accessing or using https://customgform.com and our form customization services, you agree to be bound by these Terms. If you represent an organization, you confirm that you have the authority to bind that entity.

2. Description of the Service

CustomGForm is a cloud-based software-as-a-service (SaaS) application that enables users to customize, style, and embed Google Forms on websites, alongside optional add-ons including custom file uploads, e-signatures, location detection, and AI styling tools. CustomGForm securely ingests and records responses in our database to ensure reliable persistence and automatically forwards them to Google Forms.

CustomGForm is an independent product and is not affiliated with, sponsored by, or endorsed by Google LLC.

3. Account Registration & Security

To use administrative dashboard features, you sign in via email magic links or Google OAuth. You agree to:

• Provide accurate account information.
• Maintain the security and confidentiality of your credentials.
• Promptly notify us at [email protected] of any unauthorized access.
• Take responsibility for activities occurring under your account.

4. Acceptable Use Policy

You agree not to misuse the service. Specifically, you may not:

• Use forms created with CustomGForm for phishing, deceptive credential harvesting, or capturing passwords and banking credentials.
• Distribute malware, viruses, or malicious scripts through file upload addons or custom forms.
• Publish or collect content that is unlawful, defamatory, fraudulent, or promotes harassment or hate speech.
• Attempt to reverse-engineer, disrupt, or bypass rate limits or security mechanisms of the service.
• Violate Google's terms of service or applicable privacy regulations.

We reserve the right to suspend or remove access to any account or form that violates this policy.

5. Subscriptions, Payments & Refunds

A. Merchant of Record

Our order and billing processes are conducted by our online reseller and Merchant of Record, Paddle.com. Paddle handles payment processing, billing inquiries, VAT and sales tax calculations, and provides B2B invoices for business customers.

B. Subscription Renewals & Cancellations

Paid subscriptions renew automatically at the end of each billing period (monthly or annual) unless cancelled. You may cancel your subscription at any time via your dashboard or Paddle's customer portal. Cancellation takes effect at the end of your current paid billing period.

6. Content and Intellectual Property Ownership

A. Your Content and Form Data

You retain 100% of your ownership, title, and intellectual property rights in and to your Google Forms, branding assets, logos, questions, and all respondent submissions collected and stored through the service. CustomGForm stores and synchronizes responses solely to provide the service, deliver redundancy against Google Forms submission failures, and execute configured integrations on your behalf.

B. CustomGForm Intellectual Property

CustomGForm and its licensors retain all right, title, and interest in and to the platform, including the software, libraries (cgf-lib), user interface components, templates, AI prompt workflows, documentation, and trademarks.

7. Third-Party Dependencies (Google Forms)

CustomGForm interoperates with Google Forms and Google Workspace APIs. We make every reasonable effort to ensure ongoing compatibility, but are not responsible for modifications, outages, or restrictions introduced by Google.

8. Warranty Disclaimers & Force Majeure

To the maximum extent permitted by applicable law, the service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, or uninterrupted availability.

We shall not be liable for any delay or failure in performance resulting from causes beyond our reasonable control, including server or cloud provider outages, network disruptions, modifications or downtime of third-party platforms (such as Google Forms), cyberattacks, acts of government, or force majeure events.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall CustomGForm, its operator, or its licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business interruption.

Total aggregate liability for all claims arising out of or related to these Terms or the service shall not exceed the greater of one hundred US dollars ($100) or the amount paid by you to CustomGForm during the twelve (12) months preceding the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless CustomGForm, its operator, and affiliates from and against any third-party claims, liabilities, damages, losses, and reasonable legal expenses arising out of or related to: (a) your use or misuse of the service; (b) any forms, questions, brand assets, or respondent data collected or distributed through your account; (c) your breach of these Terms or the Acceptable Use Policy; or (d) your violation of applicable laws or third-party rights, including privacy and data protection regulations.

11. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the Laws of the Republic of Poland. Any legal dispute arising from or related to these Terms shall be submitted to the competent courts in Poland. If you are a consumer residing in the European Union, mandatory statutory consumer protection laws of your country of residence remain unaffected.
